2 cops that need to be unemployed

That's my initial thoughts but I've learned that I need to wait for the whole story. Sometimes things aren't what they seem.

Failure to show ID is apparently not an arresting offense in that state. The civilian stated that, and the police didn't deny it. So we've got knowingly false arrest in front of the man's kid, and that includes the take down to the ground. The first cop has to go for that. The second cop never intervened to stop his partner. He has to go for that.

Naturally, the more likely result is the slap on the wrist approach, but firings are what's needed. It's one thing to screw up because of ignorance. It's another thing to deliberately crap on someone's rights. It's not that we need to hold police to some ridiculously higher standard than we'd hold civilians, it's that we need to hold police to consistent standards. If, because of their training, cops are given leeway in "suspicion" situations with regards to what's considered probable cause or reasonable suspicion, for example (and they are), then they need to be punished for not living up to that higher training in situations like this one.

I see videos all the time of these Sov Cit nutjobs giving cops all kinds of shit, riding with no registration - inspection - insurance, and they are let off with a (weak) warning. Why? Yet a guy out walking, early morning or not, gets harassed and then jacked up in front of his kid? All because he didn't bow down to the authoritah?

If you're in a state without compulsory ID:


"Am I being detained?"

"Under advice of counsel, I'm not going to answer any questions (and whatever else is deemed necessary to invoke your Miranda rights in your state), and I don't consent to any searches?"



And, if you've got a camera with you, film every interaction, using an app that does immediate uploading/livestreaming, so that the taking of your phone does not lead to the erasure of all the evidence.

Know your states ID laws - both traffic and non-traffic.

Most (all?) states require ID on a traffic stop. Makes sense.

Outside of that, in Texas it's Penal Code 38.02. Boiled down - if lawfully arrested you must ID. If lawfully detained you may choose to ID, but can be charged if you provide false information. Many Texas cops will try to convince you it's a case of arrest or detain, you must ID.

As for the other assertions they may make - impeding an investigation, this is an "investigatory" stop, etc - consult a lawyer.
 
As you all know, I watch tons of these bad cop videos. It's what I do. I agree with everything @Deus Irae says plus I'd add a couple of things. Get a dashcam, preferably one that monitors your speed. If you have a video, the cops have a harder time lying on you. Secondly. I'd recommend this service: https://attorney-shield.com/ . It's put together by 2 First Amendment Auditors (Long Island Audit and Lackluster). What it is is a 24 hour a day system where you can get a lawyer on the phone during your traffic stop or any interaction with police. It also records the whole interaction and puts it in a cloud. The lawyer stays on the phone the whole time and makes sure your rights aren't violated. It could save you a bunch of money and lots of headaches.
