A consumer thread

So this is huge:

In a major ruling, a federal court has issued a permanent injunction requiring Google to significantly alter its Android operating system and Google Play Store, specifically mandating that the tech giant allow greater access for third-party app stores.

This follows a jury’s unanimous verdict that Google violated antitrust laws in its dealings with Epic Games, Inc.

The ruling, issued by U.S. District Judge James Donato on Oct. 7, will take effect on Nov. 1 and remain active for three years within the United States...

The largest North American producer of french fries is shutting down its plant in Washington and laying off hundreds of employees, company officials announced in a recent earnings report.

Lamb Weston Holdings, Inc. president and CEO Tom Werner cited “soft” restaurant traffic and frozen potato demand in an October 1 press release detailing the business’s failures in the first quarter of Fiscal Year (FY) 2025.

Compared to the first quarter of FY 2024, Lamb Weston’s net income declined by 46 percent to $127 million, the company highlighted.
According to Werner, “key actions” to restructure the business include closing its “older, higher-cost” facility in Connell, Washington, which would reduce its total workforce by approximately four percent.

That means 375 workers will be out of a job, Fox Business reported.

“We delivered first quarter financial results that were generally in line with our expectations, driven by sequentially improved volume performance, solid price/mix, and strict management of operating costs,” Werner said. “However, restaurant traffic and frozen potato demand, relative to supply, continue to be soft, and we believe it will remain soft through the remainder of fiscal 2025.”...

7-Eleven Inc. remains a top convenience store chain in North America, but its parent company, Seven & i Holdings Co. Ltd., plans to trim its store count by 444 locations.

The "underperforming" stores were selected based on current strategic long-term plans, the company shared during its Oct. 10 earnings call. 7-Eleven currently operates more than 13,00 c-stores in the United States, Canada and Mexico. A list of specific stores slated for closure was not immediately released.

In its earnings report for the six months ended Aug. 31, Seven & i noted that while the North American economy is generally in a good state, this is not the case across all income levels, which contributed to multiple months in a row of declining foot traffic...

If you’re worried your phone might be spying on you, sharing your data and location without you realizing, then a new report this week will make alarming reading.

“You can’t say no to Google’s surveillance,” the Cybernews research team warns, describing a secretive stream of data they say continually transmits from a new phone to Google’s servers. Even more “concerning,” they say, “the phone periodically attempts to download and run new code, potentially opening up security risks.”...

gross. and they want us to update our messaging apps we use for texts which I am sure enables them to do even more spying. it's bad enough that even though I don't use the Google based messaging app and refuse to update it as google wants, it made me sign in to my Google account to continue to use the Play Store. it's friggin ridiculous. it almost makes me want to go back to a flip phone with no data.

A massive meat recall prompted by listeria concerns is affecting products in some of the most popular grocery stores across the U.S., including Walmart, Public, Target, Aldi, Amazon, Trader Joe's and more.

Pre-cooked meat producer BrucePac has released more information about the products impacted by its nearly 10 million-pound recall first announced by the U.S. Department of Agriculture (USDA) Wednesday. Routine testing found evidence of listeria monocytogenes on BrucePac ready-to-eat poultry, which can cause a listeriosis infection if consumed.

Initially, USDA and BrucePac released a general warning about the roughly 9,986,245 pounds of meat and poultry subject to recall, followed by later updates on specific products and locations where they are sold. Affected products were shipped to establishments and distributors nationwide, including restaurants and other food institutions, and appear in salads, frozen meals and other pre-packaged foods off different brands sold at a variety of locations.

As of Sunday, the USDA has a 326-page document of specific retailers, brands and food items containing the recalled meats. Here's what we know.

What kinds of products are recalled?
Sandwiches, wraps and salads are the primary prepared foods affected by the recall. Frozen meals containing chicken products ranging from pastas and burritos to bowls and family meals are also affected.

What to do if you have a recalled product
The USDA advises consumers who have purchased these products not to eat them and instead throw them away or return them to the place of purchase. Retailers with the products in stock are likewise advised not to sell recalled products and to dispose of or return them.

There have been no confirmed reports of adverse reactions linked to these products, but anyone concerned about an injury or illness should contact their healthcare provider.

Listeriosis or listeria poisoning symptoms
Listeriosis, or listeria poisoning, is a foodborne bacterial infection most commonly caused by the bacterium Listeria monocytogenes. It is considered a serious condition and can be dangerous or life-threatening, especially to older adults, people with weak immune systems and pregnant people.

According to the USDA, symptoms include:

Fever

Muscle aches

Headache

Stiff neck

Confusion

Loss of balance

Convulsions

Diarrhea

Other gastrointestinal symptoms

Miscarriage, stillbirth, premature delivery and/or life-threatening infection of newborn infants

Death

People in higher-risk categories who experience flu-like symptoms within two months after eating contaminated food should seek medical care and tell the health care provider about eating the contaminated food, said the USDA.

If you're stuck being a Kroger shopper, you'd better start pressuring them before it's too late:

Democratic congresswoman Rashida Tlaib recently sent a letter to Kroger over the grocery giant’s purported plan to introduce digital price tags that could be changed in an instant to raise or lower prices for shoppers based on the time of day, the weather, or any other number of factors. But one particular detail in Kroger’s plan is raising the most eyebrows: The company intends to put cameras in stores that would be used for facial recognition.

News leaked over the summer that grocery giant Kroger was partnering with Microsoft to use electronic shelf labels, shortened in the grocery industry as ESLs, as part of an AI push to institute dynamic pricing at its grocery stores. The plan also includes so-called Enhanced Display for Grocery Environment (EDGE) shelf displays that would reportedly include cameras to capture customer information, including images of faces to better tailor ads...

The laboratory-grown “meat” industry faces significant challenges securing the funding necessary to sustain itself. Industry experts claim they need substantial government assistance to survive; with various sectors within agrifood tech seeing a steep decline in investments since early 2022, and private capital for lab meat almost vanishing.

According to preliminary data from AgFunder, funding in the lab meat sector peaked at $989 million in 2021, decreased to $807 million in 2022, and then sharply dropped by 78 percent to just $177 million in 2023...

...Robert Jones, Vice President of Global Public Affairs at Mosa Meat, warns that “[t]here’s a valley of death we’re not going to cross as an industry without a massive infusion of public investment”—referencing the €60 million ($66 million) allocated by the Dutch government in 2022 as a model.

With the economic case for lab meat deteriorating rapidly, the environmental case for it is also unraveling. Recent studies suggest that—far from being a green alternative to traditional, farm-reared meat—so-called “cultivated meat” produces up to 25 times more CO2...

I don't eat at Denny's, so this doesn't impact me. But, once again, we see the bean counters doing all the wrong things in response to problems:

The American institution known as Denny’s will be closing 150 restaurants over the next year while reducing its menu options and considering a change to its famous 24/7 operating schedule.

Denny’s announced the closings in an earnings call on Tuesday, saying it will close 50 locations by the end of 2024, roughly a tenth of its 1,375 locations in the United States. The company said that “underperforming restaurants” have been weighing down its overall bottom line...

,,,Denny’s will also be reducing its menu down from 97 items to 46 items, with the company noting that adults were ordering off the kids menu to save money...
